Terms of sale

Seller of the products present on the online catalogue of the shop.qooder.com website is New Works Webtech S.r.l. with registered office in via San Gregorio 44, 20124 Milan (Italy) and operative office in Viale Lombardia, 29, 22032 Albese con Cassano (CO) (Italy) (VAT No. and Tax Code: 02658930132). Conclusion of the contract

This agreement between the Seller and the Customer is concluded when the Seller sends the order confirmation to the Customer in accordance with the terms and conditions set out in the following Article. The conclusion of the contract implies that the Customer has read and fully accepted these General Terms and Conditions of Sale. If the Customer is a consumer, once the online purchase procedure has been completed, they shall print or save an electronic copy and in any case retain these General Terms and Conditions of Sale, in compliance with the provisions of the regulations on distance selling. If the Customer does not intend to accept the General Terms and Conditions of Sale, they must not proceed with sending the order at the end of the purchase process on the Website. The availability of the Products on the Website is normally communicated on the Website itself. However, by placing an Order, the Customer also accepts partial delivery of the Products ordered. In the event of partial delivery of the Products, the Seller shall refund the Customer the amount already paid corresponding to the value of the Products not delivered.

The Seller reserves the right not to fulfil orders that have already been accepted if sufficient security and guarantee conditions are not met in relation to online payments or if the information and data provided by the Customer are incomplete and/or insufficient to fulfil the order.

Purchase modalities

The Customer can only purchase the products present in the online catalogue at the moment of the order submission and viewable online at shop.qooder.com as described in the relevant information sheets. The order shall be validly processed upon receipt on the e-mail box communicated by the Customer of the confirmation of the payment of the order itself. Correct receipt of the order shall be confirmed by the Seller by means of an e-mail reply sent to the e-mail address communicated by the Customer. This confirmation message shall contain an order number to be used in any further communication with the Seller. The message shall contain all data entered by the Customer, all information relating to the essential characteristics of the goods, the price, payment methods and delivery terms and costs. The Customer shall verify its correctness and promptly communicate any corrections to Customer Service, according to the procedures described in this document. In the event of non-acceptance of the order, the Seller shall promptly notify the Customer.

Prices

The products will be sold at the list prices in force at the time of the order by the Customer and without delivery costs, which will be counted at the time of the order.

All prices indicated for products available on shop.qooder.com intended for countries belonging to the European Union are to be understood as inclusive of VAT.
All prices indicated for products available on shop.qooder.com intended for countries outside the European Union don’t include VAT and don’t include any import duties and taxes.
Shipping prices include VAT.

Order preparation

From the moment the Customer places an order on shop.qooder.com website, the time required for the preparation and the shipment of the purchased items depends on the availability of the products. On the website for each product the availability and the order preparation time is indicated. The wording "Shipping in 24/48 hours" indicates the time needed to process the order and prepare the package, and then proceed to shipping. Normally, the contracted courier delivers in Italy within 24/48 hours from dispatch and in Europe within 72/96 hours from dispatch. The words "Delivery in 24/48 hours" indicate the time for delivery of the order within the Italian territory excluding islands and uncomfortable areas. In the case of a multiple order, shipment may take place when the order is complete, i.e. after all the products ordered have been found. If there are, for example, products among these that are marked "In Reservation" in the card, the order may be processed when these products are also available. If, when an order is being processed, a product is no longer available, because it is out of stock or cannot be found, an e-mail will inform the Customer of the inconvenience and the order will be updated with the deletion of the unavailable item. Other products will be dispatched and the amount of the unavailable item will be automatically deducted from the total amount indicated at the time of purchase. Regardless of the payment method chosen and in the case of prepayment, the customer will be refunded the value of the missing item.

Product photos

The photos on the site of the products on sale are for illustrative purposes only; the manufacturer reserves the right to make changes to the products with respect to the photos on the site without giving prior notice. The Seller will endeavour as far as possible to update the photos of the products according to these variations.

Statutory Warranty - Conventional Warranty - Defective Goods

We invite you to examine the protective legislation on Legal Warranty ("Consumer Code" - art. 128 et seq. supplementing the Civil Code), which states that for consumers the conformity warranty is two years from delivery of the product, upon presentation of the purchase invoice/receipt.

Batteries have a 12-month warranty, while product components subject to wear and tear are not covered by the warranty.

The warranty is only one year for those who buy not as consumers but as entrepreneurs or professionals, providing their VAT number and requesting an invoice.

New Works Webtech S.r.l. acts as an intermediary appointed by Hibexon SA - Rappresentanza fiscale in Italia c/o E-Labora STP Srl, Via Vaghi 19 - 17051 Andora (SV) - P.Iva 01938130091 for online sales operations of vehicles, spare parts and accessories. The warranty on vehicles, spare parts and accessories, and more generally on all goods purchased, is provided directly by Hibexon SA - Rappresentanza fiscale in Italia c/o E-Labora STP Srl, Via Vaghi 19 - 17051 Andora (SV) - P.Iva 01938130091.

Right of withdrawal

If you are a consumer, i.e. you are purchasing for personal and non-professional use, you may withdraw from the purchase without providing any reason within 14 days of receiving the product.

Applicable Law and Jurisdiction

This contract is governed by Italian law. For the resolution of civil and criminal disputes arising from the conclusion of this Contract, if the Customer is a consumer, the territorial jurisdiction shall be that of the Court of reference of his/her municipality of residence; in all other cases, the territorial jurisdiction shall be exclusively that of the Court of Como.
